Public exhibition of Amendment C232melt to the Melton Planning Scheme occurred between Thursday 11 April and Thursday 16 May 2024.

Submissions are provided to the Planning Authority in accordance with the Planning and Environment Act 1987. Submissions are part of an open public process where all parties affected by the planning scheme can provide input into the amendment. If you chose to make a submission, you consented to your submission being made public and being identified as the author of the submission. Your submission will be made available for public inspection at Melton City Council until two months after final approval of the planning scheme amendment.

Council Meeting 24 June 2024

At the Ordinary Meeting of Council of 24 June 2024, Council considered the 34 submissions received in response to Amendment C232melt to the Melton Planning Scheme during the public exhibition period. 

It was resolved at this Ordinary Meeting of Council that Council request the Minister for Planning appoint an Independent Planning Panel to review all submissions received and the planning scheme amendment.

Planning Panel

The Minister for Planning has appointed an Independent Planning Panel to hear and consider submissions.

In accordance with clause 4(2) of Ministerial Direction No,15 the following panel hearing days have been set for this amendment:

  • Directions hearing - in the week commencing 22 July 2024
  • Panel hearing - in the week commencing 26 August 2024

Amendment Description

Melton City Council has prepared Amendment C232melt to the Melton Planning Scheme to implement the recommendations of the Toolern Development Contributions Plan Review and Toolern Precinct Structure Plan Refresh, February 2024.(PDF, 3MB)

The amendment applies to any land in the City of Melton, which is covered by:

  • Clause 37.07 Urban Growth Zone, Schedule 3 Toolern Precinct Structure Plan; and
  • Clause 45.06 Development Contributions Plan Schedule 3, Toolern Development Contributions Plan.

The amendment will amend Schedule 3 to Clause 45.06 Development Contributions Plan to introduce revised charges in the Development Infrastructure Levy (DIL), which is to be paid by developers, and the Community Infrastructure Levy (CIL), which is paid by the new homeowners in the Toolern PSP area (as shown in map below).

The proposed changes to the Community Infrastructure Levy (CIL) amounts payable by each dwelling is shown in the table below:

The amendment will make other changes to the Melton Planning Scheme, including the following:

  • Amend Schedule 3 to Clause 37.07 Urban Growth Zone to make non-government schools a Section One Use, increase the shop floor area in Cobblebank Metropolitan Activity Centre where no permit is required, making a dwelling with a frontage of more than two metres in a Commercial 1 Zone a Section 2 Use, and adding a buildings and works provision for non-government schools. Changes have been made to ensure the schedule is consistent with the Form and Content of Planning Schemes Ministerial Direction (Minister for Planning, 19 January 2022).
  • Amend the Schedule to Clause 43.01 Heritage Overlay to remove an individual place (HO74) 148-200 Abey Road, Cobblebank as it burnt down in 2014.
  • Delete HO74 from 148-200 Abey Road, Cobblebank and amends Planning Scheme Map 8HO.
  • Amend the Schedule to Clause 66.04 Referral of Permit Applications Under Local Provisions to move referral provisions from Schedule 3 to Clause 37.07 Urban Growth Zone to this provision.  Changes have been made to this provision to ensure the schedule is consistent with the Form and Content of Planning Schemes Ministerial Direction (Minister for Planning, 19 January 2022).
  • Amend the Schedule to Clause 72.04 Incorporated Documents by inserting the following documents:
    1. Toolern Precinct Structure Plan (including Native Vegetation Precinct Plan), July 2011 (Amended June 2022); and
    2. Toolern Development Contributions Plan, July 2011 (Amended June 2022).

Public Exhibition of Amendment C243melt to the Melton Planning Scheme occurred between 11 July and 12 August 2024.

Three submissions were received during the Public Exhibition period as follows:

Submissions are part of an open public process undertaken in accordance with the Planning and Environment Act 1987 where all parties affected by the planning scheme amendment can provide input. Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make. Name and contact details of submitters were required for council to consider submissions and to notify such persons of the opportunity to attend council meetings and any public hearing held to consider submissions.

The planning authority must make a copy of every submission available on its website for any person to inspect free of charge for two months after the amendment comes into operation or lapses. Personal/contact details will be redacted from the submission.

Amendment Details

The amendment proposes to relocate a horse-riding school operated by the Riding for Disabled Association of Victoria. The amendment relates to land at two sites in the Rockbank North Precinct Structure Plan area, the existing site and the proposed new temporary site as follows:

Existing site (Aintree)

  • Lot A on Plan Number PS828137 at Taylors Road, Aintree 3336 (Standard Parcel Identifier: A\PS828137)

Proposed new temporary site (Bonnie Brook)

The adjoining parcels of land at:

  • 41 Newfoundland Circuit, Bonnie Brook 3335;
  • Lot 6 on Plan Number TP956560 at Tarletons Road, Bonnie Brook 3335 (Standard Parcel Identifier: 6\TP956560); and
  • Lot 7 on Plan Number TP956560 at Tarletons Road, Bonnie Brook 3335 (Standard Parcel Identifier: 7\TP956560)

Overview of the proposal

  • The horse-riding school is operated by a not-for-profit organisation called the Riding for Disabled Association Victoria (RDAV).
  • RDAV provide activities involving horses for people of all types of disabilities and ages to experience therapeutic benefits, fitness and life skills development.
  • The horse-riding school has operated from its existing location (Aintree) since 2013 and are now relocating so that the site can be developed in accordance with the Rockbank North Precinct Structure Plan.
  • The use of the land for the horse-riding school at the proposed new site (Bonnie Brook) will be temporary and has an expiry date of 30 June 2034.
  • Once the horse-riding school ceases, the site (Bonnie Brook) will be developed in accordance with the Rockbank North Precinct Structure Plan which identifies the land as containing a future Active Open Space and residential area.

To facilitate relocation to the new temporary site (Bonnie Brook), the amendment introduces a new Incorporated Document into the Planning Scheme and a corresponding Specific Controls Overlay will be applied to the land.

To cease the use of the horse-riding school at the existing site (Aintree), the amendment amends the existing Incorporated Document with an earlier expiry date to correspond with its relocation to the new temporary site.

Specifically, the amendment seeks to make the following changes to the Melton Planning Scheme:

  • Insert a new Incorporated Document titled “RDAV Melton and District Riding for the Disabled Facility Incorporated Document, July 2024‟ into the Schedule to Clause 72.04 (Incorporated Documents).
  • Amend the Schedule to Clause 45.12 – Specific Control Overlay (SCO), to refer to the new Incorporated Document.
  • Insert a new Planning Scheme Map No9 SCO to apply the SCO to the subject site.
  • Amend the Schedule to Clause 72.03 - What Does This Planning Scheme Consist Of?, to identify the inclusion of the Specific Control Overlay within Map 9.
  • Amend the existing Incorporated Document, titled “RDAV Rockbank Facility Incorporated Document, July 2013 (amended July 2024)” and amend its references in Clause 51.01 and Clause 72.04.

Amendment status: Approval under consideration with the Planning Minister

Council Meeting 25 September 2023

At the Ordinary Meeting of 25 September 2023, Council considered the recommendations of the Planning Panel on Amendment C231 to the Melton Planning Scheme. It was resolved at this Ordinary Meeting that Council adopt Amendment C231 to the Melton Planning Scheme and submit the amendment to the Minister for Planning for approval.

On 2 May 2023, under delegation, the Minister for Planning appointed a one-person Panel to hear and consider submissions.

The Planning Panel was conducted online as follows:

  • Directions Hearing – 10:00am, 11 May 2023
  • Additional Directions Hearing – 9:15am, 8 June 2023
  • Panel Hearing – 14 and 15 June 2023

Council Meeting 24 April 2023

At the Ordinary Meeting of 24 April 2023, Council considered the two submissions received in response to Amendment C231 to the Melton Planning Scheme during the public exhibition period. It was resolved at this Ordinary Meeting that Council request that the Minister for Planning appoint an Independent Planning Panel to review unresolved submissions and the planning scheme amendment.

Public Exhibition

Public Exhibition of Amendment C231 to the Melton Planning Scheme occurred between 10 November - 12 December 2022.

Two submissions were received during the Public Exhibition as follows:

Submissions are part of an open public process undertaken in accordance with the Planning and Environment Act 1987 where all parties affected by the planning scheme amendment can provide input. Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make. Name and contact details of submitters were required for council to consider submissions and to notify such persons of the opportunity to attend council meetings and any public hearing held to consider submissions. Hearings may occur either in person or via electronic means, subject to COVID-19 restrictions. The planning authority must make a copy of every submission available on its website for any person to inspect free of charge for two months after the amendment comes into operation or lapses. Personal/contact details will be redacted from the submission.

Amendment Details

The Amendment implements the findings of the City of Melton Heritage Assessment Project 2020/21.

The Amendment is required to protect five heritage places outside the urban growth boundary assessed to be of local heritage significance. Including these places in the Schedule to the Heritage Overlay and incorporating the statements of significance formally recognises the heritage value of the properties. 

The Amendment also proposes to delete a portion of existing HO60 to allow for the Soldier Settlement House at 740-794 Mt Aitken Road, Diggers Rest and 10m curtilage to be included in the new HO141.

The Heritage Overlay ensures that a planning permit is required for demolition and a range of buildings and works to ensure the heritage significance is protected. Any proposal will then be able to be assessed by council having regard to the purpose and decision guidelines of the Heritage Overlay. 

In particular the amendment:

Amends the Schedule to Clause 43.01 to include the following heritage places on a permanent basis as follows:

  • HO138 – The Oaks Homestead at 1809-1859 Gisborne-Melton Road, Kurunjang
  • HO139 – Diggers Rest Army Housing Estate at Unit 1-6, Unit 8-18, 117 Diggers Rest-Coimadai Road, Diggers Rest
  • HO140 – Minns Road Bridge over Toolern Creek, Kurunjang
  • HO141 – Soldier Settlement Housing at 115-131 Napier Street, 480-580, 726-738, 740-794 & 796-830 Mt Aitken Road, Diggers Rest
  • HO142 – Hillview house at 332 Benson Road, Toolern Vale

Amends Planning Scheme Maps as follows:

  • 1HO to include HO142
  • 2HO to include HO141 and delete part of HO60
  • 3HO to include HO139
  • 6HO to include HO138 and HO140

Amends the Schedule to Clause 72.04 to incorporate the incorporated documents.

Amendment Status: Gazetted on 14 November 2023

The Minister for Planning has now approved Amendment C240 to the Melton Planning Scheme. 

Amendments to the Melton Planning Scheme which apply a Specific Controls Overlay and corresponding Incorporated Document to support the development of the New Melton Hospital.

Amendment Status: Gazetted on 3 November 2023

The Minister for Planning has now approved Amendment C239 to the Melton Planning Scheme. 

The amendment Updates the Plumpton & Kororoit Infrastructure Contributions Plan and the Infrastructure Contributions Overlay applying to land within the Plumpton and Kororoit precincts, and makes associated changes to the Melton Planning Scheme.

Amendment C236melt

Amendment status: Gazetted on 20 April 2023

The Amendment introduces and applies a Public Acquisition Overlay to part of land at 206–388 Beattys Road, Fraser Rise, to facilitate land acquisition for Indoor Recreation – Aquatic Centre, in accordance with the Plumpton Precinct Structure Plan.

The Melton Planning Scheme has been updated and the revised planning controls have now been implemented. The gazettal of this amendment follows adoption of the amendment at an ordinary meeting of Council on 14 November 2022.

Amendment status: Gazetted on 18 November 2022

The Amendment proposes to implement the recommendations of the City of Melton Electronic Gaming Planning Policy Project Reference Document, June 2017 in order to guide the location of electronic gaming machines in the municipality.

In particular, the Amendment:

  • Inserts a new Local Planning Policy for Electronic Gaming into the Melton Planning Scheme at Clause 22.13, including the City of Melton Responsible Gambling Policy, October 2014 and the City of Melton Electronic Gaming Planning Policy Project Reference Document, June 2017 as reference documents.
  • Amends the Particular Provisions at Clause 52.28, Schedule to Clause 52.28 Gaming.

Amendment C229melt

Amendment status: Gazetted on 21 July 2022

The Minister for Planning has now approved Amendment C229 to the Melton Planning Scheme.  The amendment was gazetted on 21 July 2022.

The land affected by the amendment is the driveway of 501 Brooklyn Road, Brookfield shown in the map below (hatched area). The amendment removes a redundant Public Acquisition Overlay Schedule 1 (PAO1) from the land.

Specifically, this amendment:

  • Deleted Public Acquisition Overlay Schedule 1 (PAO1) from 501 Brooklyn Road; Brookfield.
  • Amended the Melton Planning Scheme Map No 7PAO to delete the PAO1 at 501 Brooklyn Road, Brookfield

The amendment was authorised for exhibition under Section 20(2) of the Planning and Environment Act 1987 requiring limited notification to landowners, occupiers, agencies and prescribed Ministers only. The public exhibition period for this amendment occurred between 22 February – 22 March 2022 and one submission was received which is available to view below.
